They should both be fined, and motorists should lose their license. If they get hurt, seriously injured or killed (or kill somebody, in the case of hitting/running over somebody with their vehicle, get charged for murder/assault with a deadly weapon), then there's no going back or undoing the consequences that likely will result from getting caught.
